Florida Marijuana Laws

Cannabis is illegal for recreational use in Florida, meaning only state-registered medical patients can legally possess and consume it. Following the failure of the 2024 Amendment 3 ballot measure and a subsequently disqualified citizen-led petition for the 2026 ballot, adult personal use remains fully restricted.

Florida’s strict regulatory framework governs medical access, criminal penalties, and workplace standards.

Medical Marijuana Framework

Medical use was legalized via a constitutional amendment in 2016 and is overseen by the Florida Department of Health’s Office of Medical Marijuana Use (OMMU).

  • Patient Requirements: Patients must be Florida residents (or seasonal residents) and obtain an official recommendation from a qualified, certified physician. Out-of-state medical cards are not recognized.

  • Qualifying Conditions: Patients must be diagnosed with an approved debilitating medical condition, such as cancer, epilepsy, glaucoma, HIV/AIDS, PTSD, ALS, Crohn's disease, Parkinson's disease, multiple sclerosis, or comparable chronic nonmalignant pain.

  • Dispensary Restrictions: Products must be purchased exclusively from a state-licensed Medical Marijuana Treatment Center (MMTC).

  • Home Cultivation: Growing cannabis at home remains entirely illegal for both recreational users and medical patients.

Criminal Penalties for Unlicensed Possession

Possession of cannabis outside of the medical program is subject to strict criminal penalties under Florida law:

  • 20 Grams or Less: Categorized as a first-degree misdemeanor, carrying penalties of up to 1 year in jail, a $1,000 fine, and a mandatory driver's license suspension.

  • More than 20 Grams (Up to 25 lbs): Considered a third-degree felony, punishable by up to 5 years in prison and a $5,000 fine.

  • Decriminalization Limits: While select Florida cities and counties have enacted local ordinances to treat small amounts as civil infractions rather than criminal offenses, state police can still enforce state law, meaning arrests still occur.

Public Use and Workplace Protections

  • Public Consumption: It is strictly illegal to smoke or vape medical cannabis in public spaces, on public transportation, or on school grounds.

  • Employment Enforcement: Florida is an "at-will" state with no protected employment class for medical marijuana users. State appellate courts have reinforced that employers are not legally obligated to accommodate off-duty medical marijuana use and may strictly enforce drug-free workplace policies, even in cases of random drug testing.

"This last point under "Use and Workplace Protections" is incredibly import to take note of especially if you are still one of the 9 to 5 unfortunates. With any luck your company has its policy posted and you can figure out where you are at without having to actually bring the subject up with someone who you would rather not ...."
